Terms and Conditions

1. Acceptance

These terms govern your use of the TradeScope IQ mobile app and web dashboard (the "Service"), operated by TradeScope IQ (Pty) Ltd, registration number 2025/625894/07 ("TradeScope"). By creating an account or using the Service you agree to them and to our Privacy Policy. If you use the Service for an organisation, you confirm you may bind it. If you do not agree, do not use the Service.

2. The Service

TradeScope IQ lets organisations create assignments and lets field analysts complete them by answering structured questions and submitting evidence such as photos, video, audio and documents. Assignment types include physical visits, phone calls, email, web inquiry, social media links, observation and AI-assisted research. TPQ analysts are independent: unless a separate written agreement says otherwise, they are not employees of TradeScope. The platform may also be white-labelled and operated by authorised franchise partners; where a partner runs it, these terms apply alongside the partner's own agreement. We may change or discontinue features with reasonable notice.

3. Accounts and roles

• You must be 18 or older and give accurate information.
• Access depends on your role (analyst, admin or super admin). Your account may need activation by an administrator before you can use it.
• Keep your login details secret. You are responsible for activity under your account; tell us promptly if it is compromised.
• One person per account. Do not share logins.

4. Your submissions

You own the answers and evidence you submit, but you give TradeScope and the organisation that issued the assignment a non-exclusive licence to store, use, reproduce and display them to deliver the Service, produce reports and meet legal obligations. Your submissions must be:

• Truthful, original and captured by you during the assignment, with no fabricated visits, edited or staged evidence, or stock material.
• Lawful and taken only where you are entitled to be. Do not record people in a way that breaks the law, enter restricted areas, or capture private information beyond what the assignment needs.

You are responsible for obtaining any consent needed to record or photograph people. We may reject, remove or flag submissions that break these terms.

5. Acceptable use

You may not:

• Misuse the Service, interfere with it, or try to access data or accounts that are not yours.
• Reverse engineer, scrape, copy or resell the Service.
• Upload malware or unlawful, defamatory, harassing or infringing content.
• Misrepresent your identity or location, including by spoofing GPS.
• Use the Service to breach any law, or an organisation's confidentiality obligations.

We may suspend or end accounts that breach these rules.

6. Confidentiality

Assignment briefs, client names and findings are confidential. Use them only to complete the assignment, and do not share or publish them without written permission.

7. Intellectual property

The Service, its design, software and branding belong to TradeScope and its licensors. We grant you a limited, revocable, non-transferable licence to use the app for its intended purpose. Nothing here transfers ownership of our intellectual property to you.

8. Availability and third parties

We aim for reliable service but do not guarantee it will be uninterrupted or error-free. Features such as maps, push notifications and search rely on third-party providers (Google and Algolia) whose own terms apply and whose outages are outside our control.

9. Disclaimer and liability

The Service is provided "as is". To the extent the law allows, TradeScope is not liable for indirect or consequential loss, lost profit or lost data, and our total liability for any claim is limited to the fees paid by you or your organisation for the services in the 12 months before the claim arose. Nothing excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act 68 of 2008 where it applies.

You are responsible for your personal safety while carrying out assignments. TradeScope does not supervise field work, and you attend sites at your own risk and judgement.

10. Indemnity

You agree to compensate TradeScope for losses arising from your breach of these terms or your unlawful submissions, to the extent the law permits.

11. Suspension and termination

You may stop using the Service and delete your account at any time by emailing info@tradescopeiq.com. We may suspend or terminate access if you breach these terms or the law, or if we end the Service. Clauses that by nature continue, such as confidentiality, intellectual property and liability, survive termination.

12. Changes to these terms

We may update these terms. We will post the new version with a new date and tell you in the app for material changes. Continued use after that means you accept them.

13. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. The parties will first try to resolve disputes in good faith, failing which the courts of Pretoria, Gauteng have jurisdiction.
